Privacy Policy

This Privacy Policy explains how Due South Ltd ("Due South", "we", "us") collects, uses and shares your personal information when you visit or make a purchase from www.duesouth.ie (the "Site"), sign up to our emails or text messages, or otherwise interact with us. We are the data controller for the purposes of the EU General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018. 1. Information we collect
Device information. When you visit the Site we automatically collect information about your device: browser type, IP address, time zone, and cookies installed on your device, as well as the pages and products you view, the sites or search terms that referred you, and how you interact with the Site. We collect this through cookies, log files, web beacons, tags and pixels.
Order information. When you make (or attempt) a purchase, we collect your name, billing and shipping address, payment details, email address and phone number.
Marketing information. If you join our Insider Club newsletter or opt in to text messages, we collect your email address and/or mobile number, your marketing preferences, and information about how you interact with our messages (such as opens and clicks).
Customer service information. If you contact us, we keep a record of the correspondence.
2. How and why we use your information
We use your information to: fulfil orders (payment, shipping, invoices, order confirmations and delivery updates); communicate with you; screen orders for potential risk or fraud; operate, improve and optimise the Site; and, where you have opted in or where we are otherwise permitted, send you marketing about our products. Our legal bases under the GDPR are: performance of a contract (fulfilling your order), consent (email and SMS marketing, non-essential cookies), legitimate interests (site security, fraud prevention, improving our Site and services), and legal obligation (tax and accounting records).
3. Text message (SMS) marketing
If you opt in to text message marketing (for example by entering your phone number at checkout or through a sign-up form and confirming your consent), we will send you recurring automated marketing text messages. These may include promotional offers, new product announcements, back-in-stock alerts and abandoned cart or checkout reminder messages — texts prompted by items you left in your cart or a checkout you started but did not complete.
Consent to receive marketing texts is not a condition of any purchase. Message frequency varies, and message and data rates may apply depending on your mobile plan. You can opt out at any time by replying STOP to any message (or using the unsubscribe mechanism provided), and you can reply HELP for assistance or contact us at info@duesouth.ie. After you opt out you may receive a single message confirming your unsubscription. We use Klaviyo to deliver these messages (see section 5); your number is processed only for the purposes described here and is never sold.
4. Location information and location-based services
We derive your approximate location (such as country and region) from your IP address. We use this to show the correct currency and shipping options, to estimate delivery costs, to detect and prevent fraud, and to understand where our visitors come from in aggregate. We do not track your precise (GPS-level) location and our Site does not currently request it; if we ever offer a feature that uses precise location or location-based services, it will only work if you grant permission through your device or browser, and you can withdraw that permission at any time in your device or browser settings. You can also limit location inference by using a VPN or adjusting browser privacy settings, though some Site features (like local shipping rates) may work less accurately.
5. Sharing your information with third parties
We do not sell your personal information. We share it only with service providers who help us run the business, who may process it solely on our instructions and under contract:
- Shopify — hosts our online store and processes orders (Shopify privacy policy)
- Klaviyo — sends our emails and text messages and manages marketing preferences
- Payment providers — Shopify Payments, PayPal and Klarna process your payment details; we never store full card numbers
- Delivery partners — An Post and courier partners receive your name, address and contact details to deliver your order
- Analytics and advertising — Google Analytics helps us understand how the Site is used (Google privacy policy, opt out); advertising platforms such as Meta may receive limited data for measuring and delivering our ads
- Reviews — Trustpilot, to invite and display genuine customer reviews
- Impact partner — Verdn, to allocate the tree planted with your order (order reference only)
- Accounting — our accounting software and advisers, for bookkeeping and tax compliance
We may also share information to comply with applicable laws, respond to lawful requests, or protect our rights.
6. Cookies
We use cookies and similar technologies as described above. Non-essential cookies (analytics, advertising) are used in line with the choices you make in our cookie notice, and you can manage or delete cookies in your browser at any time — see allaboutcookies.org. Note that we do not change our data practices in response to browser "Do Not Track" signals.
7. Behavioural advertising
Where permitted, we use your information to show you targeted ads for our products. You can learn how targeted advertising works at the Network Advertising Initiative, and opt out via Facebook, Google or the Digital Advertising Alliance.
8. International transfers
Some of our service providers process data outside the European Economic Area, including in the United States and Canada. Where they do, we rely on safeguards recognised under the GDPR, such as adequacy decisions and the European Commission's Standard Contractual Clauses.
9. How long we keep your information
We keep order and transaction records for as long as required for tax and accounting purposes under Irish law (generally six years plus the current year). Marketing data is kept until you unsubscribe or ask us to delete it; suppression records (so we know not to contact you) are kept indefinitely. Device and analytics data is retained in aggregate form.
10. Your rights
Under the GDPR you have the right to: access the personal information we hold about you; have it corrected or deleted; restrict or object to its processing; receive it in a portable format; and withdraw consent at any time (for example, unsubscribing from emails or replying STOP to texts) without affecting the lawfulness of processing before withdrawal. To exercise any of these rights, email info@duesouth.ie — we will respond within one month. You also have the right to lodge a complaint with the Data Protection Commission (Ireland's supervisory authority) at www.dataprotection.ie.
11. Children
The Site is not directed at children and we do not knowingly collect personal information from anyone under 16.
12. Changes to this policy
We may update this policy from time to time to reflect changes in our practices or for operational, legal or regulatory reasons. The date at the top shows when it was last revised.
